Letter (again?) to MOM
To Whom It May Concern:
I had been working in a Korean construction company as an Admin and Personnel Manager for 15 years, literally since it was founded in 1990. Recently the Finance & Admin General Manager cited restructuring as a reason for me to leave the company. Effectively it was retrenchment in the worst possible scenario. There were 2 other colleagues involved. One colleague had worked there for almost 9 years. We were compensated a total of 2 months for our contributions and long service in the company. As we felt that the treatment was unfair, this matter was brought to the Union and subsequently referred to the Ministry of Manpower. The said company handled this issue poorly and let me state the reasons why I would want a chance of appeal:

The said company handled this issue poorly and let me state the reasons why I would want a chance of appeal:
- I had not failed in my duty of work and was terminated without cause. Even though restructuring was the reason, said company recruited again within 1 month of our departure and remuneration was awarded as per normal to remaining staff.
- All previous employees who were terminated the year before received compensation equivalent to the number of years of service in the company. If the precedent was set then, why should this not be the standard?
- It was reported on the Business Times 21 Feb 2007, said company has been awarded a total of S$675 million for 2 projects in power and wafer plants. If so, how is it that the company claims it is not able to pay out the retrenchment benefits?
I feel that a conglomerate such as the said company could have treated employees of the organization in a more humane manner. I soon realised that instead of wanting to settle the matter amicably, said company however, tried to discredit my reputation in front of the authorities. I was accused of the following and many untruths were willfully said:
- Destroying and removing employee records of the colleague and myself. Letters of termination and past record of previous employees’ termination mysteriously disappeared. Now why would I do that if you think logically? So that if I went to the ministry (which I had planned to do) someone would be able to conveniently accuse me of the above?
- Going back to format the computer after having left said company. If I were able to do that, I’d pray very hard for the security system the company has installed to protect its assets.
- Previous employees left willingly for better jobs and compensation were given out of goodwill. It is rather a huge coincidence to have 3 staff leaving on the same day and the benefits they received coinciding with their years of service, don’t you think?
Despite having documents to prove that I had done my job in handing over the work scope to the next person, I am now faced with the extra charge of sabotage when all I wanted was an amount justifiable to what the said company is capable of giving. A person with conscience will know it is wrong to accuse another in order to protect one self. It doesn’t matter to a conglomerate that I may have a family of three to feed. Nor did they consider the difficulties for a person of my age in finding a job now. The management in said company probably thinks I am creating trouble for them, a minuscule and pointless effort since they felt that I was more than duly compensated. Because in the end, they are the one with power and I am but one person.
Being an ex-employee who first helped the company throughout the years to its present establishment, I have no wish to see things turn out this way either. It is sad that said company has treated me as such in the turn of events. I understand retrenchment and restructuring. I was after all in charge of human resources the whole time. It’s not that things should be different if I myself become the victim. I only require a fair judgment of my past contributions and adequate compensation in return.
